Pinnacle Logistics represents and warrants that it is duly and legally qualified to provide and/or arrange for all transportation services contemplated herein. Pinnacle Logistics agrees to comply with all federal, state and local laws regarding the provision of such brokerage and/or carriage services. The Parties understand and agree that Pinnacle Logistics may function as an independent entity, and not as a carrier, in selling, negotiating, providing and arranging for transportation for compensation, and that the actual transportation of shipments tendered to Pinnacle Logistics may be performed by third-Party motor carriers (“Servicing Motor Carriers”).
